1. Introduction
These Terms & Conditions govern your use of the Freshova™ website and your purchase of products from us.
By using our website or placing an order, you agree to be bound by these Terms & Conditions. Please read them carefully before placing an order.

These Terms apply primarily to consumer purchases made through the Freshova™ website.
Nothing in these Terms limits or excludes any consumer rights that cannot legally be limited or excluded.
2. Eligibility
You must be at least 18 years old to place an order through the Freshova™ website.
By placing an order, you confirm that:
- You are legally capable of entering into a contract.

- You are purchasing products for lawful purposes.

- Product images are provided for illustration and may vary slightly from the actual product.
- Genuine leather is a natural material and may have variations in texture, grain, colour and appearance.
- Minor variations do not necessarily indicate a defect.
- Product availability may change without notice.
- We reserve the right to discontinue products or make reasonable changes to product specifications where necessary.
We will not intentionally misrepresent the products we sell.
All products supplied to consumers will comply with applicable consumer protection laws, including requirements relating to description, quality and fitness for purpose.
4. Pricing
All prices displayed on the Freshova™ website are in British pounds sterling (GBP/£) unless otherwise stated.
Prices shown at checkout will include applicable taxes where required by law.
We reserve the right to change product prices before an order is placed.
A change in price will not affect an order that has already been accepted, except where an obvious pricing error has occurred.
International orders
Customers ordering from outside the United Kingdom may be responsible for customs duties, import taxes, handling charges or other charges imposed by the destination country.
Where applicable, such charges are the responsibility of the customer unless otherwise stated at checkout.
5. Orders
When you place an order through our website, you are making an offer to purchase the selected products.
After you place an order, we may send you an order acknowledgement confirming that we have received your order.
An order acknowledgement does not necessarily mean that your order has been accepted.
Your order will be accepted when we confirm that the products have been dispatched, unless we have expressly stated otherwise.
If we are unable to accept your order, we will inform you and refund any payment that has already been taken.
We may refuse or cancel an order where:

- There is an obvious pricing or product-description error.
- We reasonably suspect fraudulent or unlawful activity.

- Circumstances outside our reasonable control prevent us from fulfilling the order.
Where we cancel an order after payment has been taken, we will provide an appropriate refund.

Payment information is processed through secure payment providers. Freshova™ does not intend to store complete payment card details on its own systems.

We reserve the right to carry out reasonable fraud and security checks before processing or dispatching an order.
7. Shipping and Delivery
We deliver to destinations made available at checkout.
Delivery options, estimated delivery times and applicable delivery charges will be displayed during the ordering process where available.
Delivery times are estimates and may vary depending on:
- Destination;
- Delivery method;
- Product availability;
- Courier services;
- Customs procedures; and
- Circumstances outside our reasonable control.
We will take reasonable steps to dispatch orders within the stated timeframe.
For UK consumer orders, goods will generally be delivered within 30 days unless a different delivery period has been agreed with you or another period is permitted by applicable law.
If an order is significantly delayed, please contact us so that we can investigate the matter and provide an appropriate solution.
Nothing in these Terms affects your statutory rights regarding delivery.
8. Risk and Ownership
Unless otherwise required by applicable law, the risk in the goods passes to you when you, or a person nominated by you, physically receives the goods.
Ownership of the goods passes to you when we have received full payment for the goods and the goods have been delivered to you.
Where applicable law provides a different rule, the applicable law will take precedence.
9. Cancellation and Your Right to Change Your Mind
For eligible UK online consumer purchases, you generally have the right to cancel your order within 14 days of receiving the goods, without giving a reason.
After telling us that you wish to cancel, you generally have a further 14 days to return the goods.

- Confirmation that you wish to cancel the order.
You may also use the cancellation form included at the end of these Terms, although you are not required to use that form if you clearly communicate your decision to cancel.
Handling products after delivery
You may handle the goods to the extent reasonably necessary to establish their nature, characteristics and functionality, in the same way you would reasonably be able to inspect them in a shop.
If goods have been handled beyond what is reasonably necessary and their value has been diminished, applicable law may permit a deduction from the refund.
Certain products may be excluded from cancellation rights where permitted by applicable law, including certain personalised or made-to-order goods.

Please do not send an item back without first contacting us and receiving the appropriate return instructions where these are required.
Returned products should generally:
- Be in their original condition, subject to reasonable inspection and fitting;
- Not have been worn beyond what is reasonably necessary to inspect or try them;
- Be free from damage caused by unreasonable use;
- Include the original packaging where reasonably possible; and
- Be accompanied by proof of purchase.
Nothing in this section removes or restricts any statutory consumer rights.
11. Refunds
Where you are legally entitled to a refund, we will process it in accordance with applicable consumer protection law.
For eligible cancellations under the applicable UK distance-selling rules, refunds will generally be made within 14 days of the relevant statutory deadline, including the applicable refund of standard delivery charges.
Refunds will normally be made using the original payment method.
The time taken for a refund to appear in your account may depend on your bank or payment provider.
Where the customer selected a more expensive delivery option than our standard delivery option, we are generally only required to refund the cost of the standard delivery option where the law provides for a refund of delivery charges.
12. Exchanges
We may offer exchanges subject to product availability.
If you request an exchange and the replacement product is unavailable, we may offer a refund or another appropriate solution.
Exchange arrangements do not remove or replace any statutory rights you may have in relation to faulty, defective, incorrectly supplied or misdescribed goods.
13. Faulty, Damaged or Incorrect Products
If your product arrives:
- Faulty;
- Damaged;
- Defective;
- Incorrect; or
- Not as described,
please contact Freshova™ as soon as reasonably possible with your order details and, where appropriate, photographs showing the issue.
We will assess the matter and provide an appropriate remedy in accordance with applicable consumer protection law.
Consumers have statutory rights concerning goods that are not as described, are not of satisfactory quality or are not fit for purpose. These rights cannot simply be excluded through these Terms.
Where the law requires us to provide a remedy, we will do so.
14. Return Shipping
For unwanted items cancelled under applicable consumer cancellation rights, the customer may be responsible for the direct cost of returning the goods where the law permits this and we have informed the customer of that responsibility.
Where a product is faulty, defective, damaged, incorrectly supplied or otherwise requires a remedy under applicable law, Freshova™ will provide an appropriate remedy and cover return delivery costs where required by law.
Returns must follow the return instructions provided by Freshova™.
15. International Orders
Freshova™ may accept orders from customers outside the United Kingdom.
International customers should be aware that:
- Delivery times may vary by destination.
- Customs clearance may cause delays.
- Import duties, customs duties, taxes and other charges may apply.
- The customer may be responsible for charges imposed by the destination country.
- Consumer rights may vary depending on the country in which the customer is located and the applicable law.
Nothing in these Terms is intended to remove any mandatory consumer protection rights that apply to an international customer.

You may view and use the website for your personal and lawful shopping purposes.
You must not reproduce, distribute, modify, sell or commercially exploit Freshova™ content without our prior written permission, except where permitted by law.

This does not affect any rights you have regarding products you have purchased.

Nothing in this section is intended to reduce or remove your statutory rights as a consumer.
Consumer contracts must be fair and transparent, and terms attempting to exclude responsibility for faulty or misdescribed goods cannot be enforced.
21. Events Outside Our Reasonable Control
We will not be responsible for delays or failure to perform our obligations where the delay or failure is caused by circumstances outside our reasonable control.

- Severe weather;

- Government action;
- Industrial disputes;
- Major transport disruption;
- Courier or postal disruption;
- Customs delays;
- Serious technical failures; or

This section does not remove any rights you may have to cancel an order or receive a refund where required by law.

Changes will not affect rights that have already arisen under an order that has already been accepted, unless required by law.
24. Severability

The remaining provisions will continue to apply.
25. Entire Agreement

26. Governing Law and Jurisdiction
